S&P provides advice and legal representation in the field of military law.
S&P has a well-established team of lawyers who specialize in military personnel law. Our lawyers advice and represent members of armed forces in all administrative and personnel matters, as well as in relation to the exercise of the freedom of assembly and association.

Our lawyers have been involved in cutting-edge litigation concerning, inter alia:

  • abolition of the ban on trade unions within the armed forces
  • assistance in setting up trade unions within the armed forces
  • recognition of the right to redeem for free the years spent studying at university for officers of the Carabinieri coming from the then Corpo forestale dello Stato
  • career progressions and transfers
  • austerity measures on wages and retirement pensions
  • failure to set up a complementary welfare scheme

In these areas, S&P offers a multidisciplinary approach and is specialized in providing assistance in cases which touch upon other areas of law (international law, civil law, administrative law, criminal law), also in close cooperation with domestic and foreign law firms.

In addition, S&P represents also NGOs and trade unions in strategic litigations and in the filing of amicus curiae submissions, particularly before the Constitutional Court and the European Court of Human Rights

  • Corte europea dei diritti dell’uomo – contenzioso promosso per conto di 400 appartenenti alla Guardia di Finanza per violazione della libertà di associazione sindacale e il divieto di discriminazione – decisione dell’8 aprile 2021, Pansitta e altri c. Italia
  • Corte costituzionale – illegittimità costituzionale del divieto di associazione sindacale nelle forze armate – sentenza n. 120 depositata il 13 giugno 2018
  • Corte costituzionale – blocco degli incrementi retributivi nel pubblico impiego (2011-2015)
