Strasbourg Case-Law Bulletin No. 6/2026

The monthly update of “The Latest from the European Court of Human Rights”, the Bulletin edited by S&P Law Firm which monitors the rulings issued by the ECtHR concerning Italy, is now available.

Among the most significant rulings, it is worth noting Andrea Ciotta v. Italy, concerning the prolonged detention in prison of an individual suffering from mental health disorders, who remained in custody for a long time while awaiting transfer to a Residenza per l’Esecuzione delle Misure di Sicurezza (“REMS”) (for further details see here).

Also noteworthy is the communication to the Italian Government of the application Reed v. Italy, concerning the compatibility of the temporary prohibition on remarriage provided for by Article 89 of the Italian Civil Code with the prohibition of discrimination on grounds of sex under Article 14 of the Convention, read in conjunction with the right to marry guaranteed by Article 12, as well as with the right to respect for private life under Article 8 (for further details see here).
