S&P secures refugee status in Russian corporate raiding case

A Russian businessman was granted refugee status on grounds of political persecution by the Italian Territorial Commission in a high-profile corporate raiding case.

Corporate raiding (reiderstvo) is a widely spread form of State-sponsored persecution in Russia which rests upon the use of illegal acts, including malicious prosecution, to deprive owners of their successful businesses.

S&P, with a team lead by partner Giulia Borgna with associate Cecilia De Marziis, represented the former CEO of a leading private company in Russia.

At the height of its success, the company (and its management) became the target of an aggressive raiding campaign by a State-owned bank based on a cascade of multiple tactics. These tactics flowed upward on the scale of harassment, from a baseless demand to immediately repay a loan to the gradual replacement of key management positions with individuals chosen by the raider, misuse of the banking system to initiate a fraudulent bankruptcy through deliberate mismanagement, fabrication of criminal charges of fraud and embezzlement, extradition requests and Red Notices.

In a landmark decision, the Territorial Commission found that, when he decided to fight back against the hostile takeover of his company, our client became the target of a sophisticated and aggressive campaign of persecution by State actors. As a result, the Commission granted our client refugee status on grounds of persecution based on political opinions pursuant to the 1951 Geneva Convention.
